These Terms of Service (hereinafter — the Terms) govern the relationship between the PLATOV Service (hereinafter — the Service) and natural persons (hereinafter — the User) using this website.

Before using the Service and its services, the User must carefully review these Terms, the AML/KYC Policy, and the Privacy Policy. Use of the Service to perform any transaction constitutes full and unconditional acceptance of all provisions of these Terms. If you disagree with any clause, you must refrain from using the Service.

The Service reserves the right to amend the Terms at any time. The current version is always available on the website. Continued use of the Services following the publication of changes constitutes acceptance of the updated version.

1. General Provisions and Risk Disclosure

  • 1.1. The Service provides exchange services for digital assets (cryptocurrencies) and electronic funds of certain payment systems or banks. We are not a bank, financial advisor, or investment intermediary.
  • 1.2. Cryptocurrencies and transactions involving them entail substantial risks: exchange rate volatility, technical failures of the blockchain, the risk of hacker attacks, and regulatory changes. The User confirms that they have independently assessed all risks and bear full responsibility for their decisions.
  • 1.3. The Service shall not be liable for losses arising from the erroneous entry of payment details, loss of private keys, actions of third parties, or changes in legislation.
  • 1.4. The Service strictly complies with international FATF standards, anti-money laundering (AML) and counter-terrorism financing (CFT) recommendations, and sanctions requirements.

2. Definitions

  • Service — the hardware and software resource used to perform exchange operations, available on the Internet.
  • User — a natural person who wishes to use the services of the Service.
  • Digital currency (cryptocurrency) — a virtual asset represented on a blockchain (Bitcoin, Ethereum, USDT, and others).
  • Exchange — the operation of converting one currency into another at the Service's rate.
  • Account — the User's personal account on the website.
  • AML (Anti-Money Laundering) — the prevention of money laundering.
  • KYC (Know Your Customer) — user identification and verification procedures.
  • KYT (Know Your Transaction) — monitoring and analysis of each transaction for suspicious activity.
  • CFT (Counter-Terrorist Financing) — the prevention of the financing of terrorist activity.

3. Registration and User Requirements

  • 3.1. The User must be at least 18 years old (or have reached the age of full legal capacity in their country).
  • 3.2. Creating more than one account is prohibited.
  • 3.3. The User must have access to the Internet via a computer or other device, and must ensure connection security through anti-virus software.
  • 3.4. During registration and KYC, the User must provide accurate information.
  • 3.5. The User must provide the Service with complete and correct data for the accurate execution of operations (personal data, payment details).
  • 3.6. The User must comply with the terms of this Agreement.
  • 3.7. The User must not violate the applicable laws of the country in which they are located.

4. Powers of the Service

  • 4.1. To temporarily suspend the operation of the website in connection with technical maintenance or updates of the Service.
  • 4.2. To suspend an ongoing operation upon a request from payment systems, Users, or government authorities, or upon a complaint regarding fraudulent activity.
  • 4.3. To suspend an ongoing operation and the User's funds pending verification of the User's identity and the accuracy of the information provided.
  • 4.4. To apply and revise the discount system for Users.
  • 4.5. To reject any User's request for services without providing reasons.
  • 4.6. To terminate interaction with a User who engages in rude conduct or communication with the Service's technical support, or who provides incorrect information.

5. Procedure for Exchange Operations

  • 5.1. The transfer operation begins after funds have been received from the User.
  • 5.2. The User is solely responsible for verifying the accuracy of the recipient's details. Once funds have been sent, refunds are not possible.
  • 5.3. The User undertakes to send the specified currency in the correct network and amount as indicated when creating the exchange. The exchange may be suspended if the actual currency, network, or amount differs from those originally specified.
  • 5.4. The minimum and maximum exchange amounts are set by the Service and are subject to change.
  • 5.5. Exchange operations are conducted only on the website itself. Official email addresses, technical support chat, and Telegram channels are intended solely for communication with representatives of the Service.
  • 5.6. When exchanging cryptocurrency, the amount to be received may be recalculated at the current rate at the time of receipt of funds. This is permissible if the rate changes by more than 0.5% from the original.
  • 5.7. The operation is deemed completed once funds have been transferred to the User's details.
  • 5.8. If invalid or incorrect transfer details are provided — amount, currency, currency network, or payment details — the exchange is suspended pending the User's contact and submission of supporting information. Erroneous orders and the funds received under them are retained for one calendar month, after which the order expires, is deleted, and the funds are not returned.

6. Limitation of Liability

The Service shall not be liable for:

  • 6.1. The data entered by the User on the exchange form. If funds are transferred to incorrect details, the system does not provide for a refund.
  • 6.2. Improper actions of payment systems and banks, or transaction delays on the network.
  • 6.3. Loss or distortion of income anticipated by the User as a result of a mistaken understanding of fees or the profitability of operations.
  • 6.4. Operations carried out by third parties on the User's instructions, or compensation of losses to third parties incurred while using the Service's functionality.
  • 6.5. The administration of the Service cannot guarantee the fulfilment of the User's special requests but will make every effort to do so.

7. Force Majeure

In the event of force majeure circumstances that render the performance of contractual obligations impossible, the parties shall be released from liability for any resulting delays or non-performance.

Force majeure circumstances include: military action, strikes, epidemics, terrorist attacks, cyberattacks, earthquakes and other natural disasters, and significant disruptions in the operation of telecommunications systems.

8. Mandatory Conditions for Exchange Operations

  • 8.1. The use of the Service for unlawful or fraudulent operations is prohibited.
  • 8.2. The User is personally responsible for the legality of the sources of the funds.

All information on the website, including graphic and textual materials, software resources, and other content, is the property of the Service and is protected by copyright law. Unauthorised copying is prosecuted under the law.
